1. Scope and provider

These terms govern your use of the WishButler app, offered by RootTwoLabs UG (haftungsbeschränkt) (“we”, “us”). Full provider details are in the Legal Notice (Imprint).

2. Minimum age

Use is permitted only for adults (18 years or older). By consenting during onboarding you confirm that you are of legal age. If the information provided is incorrect, we may suspend access.

3. Service

WishButler reminds you of personal occasions and offers AI-assisted message drafts. Drafts are generated via our server (located in Germany) by our processor OpenAI (contracting entity: OpenAI Ireland Limited); OpenAI currently processes the data on servers in the USA (see the Privacy Policy for details). There is no claim to uninterrupted availability; we may temporarily restrict the service for maintenance or good cause.

4. Subscriptions, the “Extra” one-time purchase, automatic renewal and cancellation

Available in the App Store / Google Play: Free (free of charge) as well as Plus and Pro, each as a monthly or annual subscription. The price that applies is the one the respective store shows you before purchase; it may differ by country and currency. The respective store (Apple or Google) is your contractual partner for payment; billing, renewal and refunds are handled exclusively there. Subscriptions renew automatically for the chosen period unless cancelled at least 24 hours before the end of the current period via the store's subscription settings. Any statutory right of withdrawal for digital content is governed by the respective store's terms. In addition, we offer the one-time purchase “Extra”: a pack of 15 Credits for additional AI generations. The purchase is not a subscription, does not renew and can be repeated whenever needed. The monthly quota included in your plan is used up first, and only then the purchased Credits; unused Credits do not expire and remain yours even if you switch plans or your subscription lapses. On the Free plan, the Extra purchase also permanently unlocks extended generation (more suggestions per message, additional styles and the message history). For the one-time purchase, too, the price that applies is the one the respective store shows you before purchase; billing and refunds are handled exclusively via the store.

5. Liability

We are liable without limitation for intent and gross negligence and for damage arising from injury to life, body or health. For slight negligence we are liable only for breach of a material contractual obligation (cardinal duty) the fulfilment of which is essential to the proper performance of the contract and on which you may regularly rely; in that case liability is limited to the foreseeable damage typical for this type of contract. Otherwise liability is excluded. Liability under the German Product Liability Act remains unaffected.

6. AI content and your responsibility

AI messages are automatically generated drafts and may contain errors, inaccuracies or unsuitable wording. You review each draft yourself before sending and are solely responsible for the final content you send to recipients.

7. Content checks and acceptable use

The app heuristically checks input for manipulation attempts (prompt injection) and may reject generations on anomalies. We likewise check the generated suggestions automatically for demeaning content and discard individual suggestions or the entire output if the check is triggered. You agree not to use the service for unlawful, abusive or infringing content.

8. Changes to these terms

We may amend these terms, e.g. due to legal changes or new features. For material changes you will be informed in the app and asked to re-consent.

9. Governing law, language and dispute resolution

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection provisions of your country of residence remain unaffected. The German version prevails; translations are for convenience only. We are neither willing nor obliged to participate in consumer dispute-resolution proceedings.
